These are the urgent measures to protect workers from the damage caused by the DANA

This regulation includes a series of measures in the economic, financial, fiscal and labour fields to address the consequences arising from the DANA.

Below you will find a summary of what, who, how and when these measures affect, their scope and timing, with respect to Social Security measures.

What does it affect?
To the protection of employed and self-employed workers in any Social Security regime.
To the procedure for collecting Social Security contributions and for joint collection concepts carried out by the TGSS.
To the calculation of Social Security contributions when there are periods of suspension or reduction caused by DANA.
Consideration of temporary disability as a work accident when it is caused by DANA
The possibility of requesting a deferral or moratorium on the payment of social security contributions and joint collection concepts.
Who does it affect?
To companies holding contribution accounts with their business address in the areas affected by the DANA (according to annex RDL 06/2024).

To self-employed workers of the self-employed workers regime with a residence or activity address in said localities, included in any Social Security regime, to self-employed workers of the sea regime and to self-employed agricultural workers.

Any person who resides in any of the locations listed in the decree itself.

To employed or self-employed workers affected by the DANA

How does it affect? Exemptions from Social Security contributions and joint collection concepts
100% exemption of the employer's contribution to the fees accrued in the period affected by the suspension or reduction due to temporary force majeure, corresponding to the months of November 2024 to February 2025.

It applies to companies whose activity has been impeded or limited and for which a temporary employment regulation file is authorized as a result of the accidents caused by the DANA.

They will be applied to 100% of the employer's contribution christmas island b2b leads for workers whose activities are suspended or reduced due to temporary ERTE due to force majeure, for the periods and percentages of working hours affected by the suspension or reduction.

Authorization of ERTE due to force majeure by the labor authority is required.

The TGSS will apply the exemptions upon request of the company, which must make the corresponding communication:

Responsible declaration regarding each CCC in which the workers assigned to the affected work centers are registered, and month of accrual, to be submitted before the start of the liquidation corresponding to the liquidation period on which these declarations have effect.
